Terms and Conditions: VAIO Overseas Service (VOS-3701-HK)

PLEASE READ THIS DOCUMENT CAREFULLY BECAUSE IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT SHALL APPLY TO YOU.

UPON you place your order for VAIO Overseas Services ("Service") in accordance with the terms and conditions of this Contract, you are deemed to acknowledge that you are fully aware of the contents of these terms and conditions and you agree to be bound by and accept these terms and conditions.


Terms and Conditions of the Contract for VAIO Overseas Service (VOS-3701-HK)

1. Eligibility of the Service

The Service is available for those customers ("Customers") who purchased designated Sony's laptop personal computer products "VAIO" ("Product") through Sony or a Sony's official distributor in Hong Kong. The service should be purchased with the product or within forty-five (45) days after the date of purchase of the Product.
 

2.Period during which the Service is covered

The Service is valid for a period of twelve (12) months from the original date of purchase of the Product.
 

3.Designated territories where the Service is provided

No matter the Service shall be provided at no charge or for a fee in accordance with the terms of this Contract, the Service is offered only in the designated countries stated below.

Sony reserves the right to change the designated territories at its sole discretion.

North America: the US and Canada
Western Europe: Austria, Belgium, Denmark, Finland, France, Germany, Greece, Italy, Ireland, Liechtenstein, Luxembourg, the Netherlands, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom
Asia: Japan, Malaysia, Singapore
Oceania: Australia,New Zealand


 

4.Method of repair request

Subject to such conditions for repair in Section 11 of this Contract, if repair service is required Customer should place its order for repair by calling Sony at the designated Sony number. Upon Customer's request for repair, Sony will either inform Customer the address of local Sony service center which the Customer may leave the Product for repair or arrange a courier to pick up and return the Product from/to Customer at such location and time to be confirmed (depends on which designated territories the Customer is located).
 

5.Acceptance of Repairing Service

Unless Customer notifies Sony to the contrary by calling or facsimile transmission to Sony's designated telephone or facsimile machine numbers within seven (7) days of Sony's return of repaired Product and such notification is confirmed by Sony in writing within seven (7) days of the notification, the relevant repair service shall be deemed to be accepted by Customer as being in good and satisfactory condition in accordance with this terms and conditions.
 

6.Free-of-Charge repair coverage

In accordance with this Contract, repair (i.e., labor and parts replaced by new and /or reconditioned parts) at no charge applies only to the hardware unit of the Product. Software, cables, batteries, peripherals and printed materials (such as instruction manuals, labels, etc.) are not covered under the Service. All defective parts replaced under the Service will become the property of Sony.
 

7.Free-of-Charge repair conditions

Under this Contract, repair at no charge is provided for defects in materials or workmanship under standard usage (as stated in the instruction manual, labels, and other printed material included with the Product). Power and telecommunications standards for the model types designated for the Service are for use in Hong Kong. When using the Product in the designated countries, it is the Customer's responsibility to ensure that the Product is used in compliance with these specifications. When the defect is caused by use in an environment that does not meet the specifications of the Product, Customer will be charged for the repair.
 

8.Warning about damage to equipment other than the Product

Power and telecommunications standards for the model types designated for the Service apply to use in Hong Kong. Sony will not compensate for damage caused to any material or persons other than the Product when the Product is used in an environment that does not meet the specifications of the Product.
  

9.Disclaimer

SONY SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY RELATED TO THE PRODUCT. SUCH DAMAGES INCLUDE BUT ARE NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, DOWN TIME AND PURCHASER'S TIME. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THE PRODUCT IS DISCLAIMED.
  

10.For-fee repair conditions

(1) If a repair is requested under the conditions listed below, a fee will be charged:

- Cosmetic damages
- When the damage is due to accident, misuse, abuse, negligence, unauthorized commercial use or unauthorized modifications of the Product
- When the damage is due to improper operation or maintenance of the Product
- When the damage is due to connection to improper voltage supply
- When the damage is caused by transporting the Product after purchase, or by dropping or hitting the Product
- When the damage is due to acts of God; caused by fire, earthquakes, floods, lightening, pollution, power surges
- When the damage is due to the attempted repair by any party other than a Sony authorized personal computer service facility
- When malfunction results from the use of the Product in conjunction with accessories, products or ancillary or peripheral equipment or where it is determined by Sony that there is no fault with the Product itself
- When there is a request to ship the Product outside of the designated countries in which the repair is requested
- When the factory applied serial number has been altered or removed from the Product



(2) Please be aware of the following in connection with repairs for which there is a charge:

- For repairs charged, Customer must pay for parts, labor, and shipping charges.
- Details of the fee will be explained in cases where Customer will be charged.
- The fee may differ from the fee charged on an equivalent repair in Hong Kong due to currency fluctuations, differences in parts prices, etc.
- If Sony has found the repair to be for-fee after receiving the Product, Sony will contact Customer before performing the repair. Customer will be informed of the charge and asked to confirm whether the repair should be performed. In such circumstances, the period during which the Product is away from Customer may be longer than when repairs are performed at no charge.
- In some designated countries, Customer may be requested by Sony to make payments for for-fee repair by certain credit cards.
- If Sony decides that Customer will be charged for the repair, but the Product is returned to Customer un-repaired because Customer do not wish to have the repair performed, the shipping cost will be charged to Customer.

11.Important notice about repair procedures

(1) The conditions for accepting a repair request are as follows:
-Customer own either of the Products and have purchased the Service for the Product
-Customer will stay in the designated countries for sufficient period for Sony's return of the repaired Product.
-The contents of Customer hard drive, including any data Customer have stored or software Customer have installed, are duly backed up by Customer before the Product is collected

(2) It is Customer's responsibility to back up the contents of Customer hard drive, including any data Customer have stored or software Customer have installed, as well as to remove recording media (such as floppy discs, CDs) and peripherals from the Product before handing over the Product to Sony. If such programs, data, recording media and peripherals are within the Product at the time Sony receives the Product, Sony assumes that Customer have forgone all rights to such items. Sony will not be responsible for any damage to or loss of any peripherals, programs, data or other information stored on any media or any part of any Product serviced hereunder.

IF DURING THE REPAIR OF THE PRODUCT THE CONTENTS OF THE HARD DRIVE ARE ALTERED, DELETED OR IN ANY WAY MODIFIED, SONY IS NOT RESPONSIBLE WHATSOEVER. THE PRODUCT WILL BE RETURNED TO THE CUSTOMER CONFIGURED AS ORIGINALLY PURCHASED (SUBJECT TO AVAILABILITY OF SOFTWARE.)

(3) Be sure to remove all third party hardware, software, features, parts, options, alterations and attachments not warranted by Sony prior to sending the Product to Sony for repair. Sony is not liable for any loss or damage to these items.

(4) Depending on the estimated length of the repair, parts availability, or the nature of the problem, Sony may handle the repair differently from those stated in this Contract.

(5) Depending on parts availability, Sony reserves the right to use the best available alternative part under local circumstances of the country in which the repair is conducted.

(6) Sony does not offer on-site repair service under the Service.

(7) Sony does not offer data back-up service at any time.
  

12.Personal Data (Privacy)

To enable Sony to render the Service to Customer, Sony shall collect Customer's personal information (such as Customer's name, address, phone number and passport number) ("Customer's said Information") as well as the serial number and date of purchase of the Product for providing the Services. Customer's said Information will be kept confidential at contact centers and repair centers of Sony subsidiaries in the designated countries for a reasonable period. For the purpose of confirming Customer's entitlement and to render Customer the Service in the designated countries, Sony may share Customer's said Information among the other authorized departments of our company and any associated companies in the Sony Group. Customer can always provide Sony with Customer's latest personal information and/or require Sony to correct any data which is inaccurate or outdated.

All instructions for access and correction of personal data and/or any query regarding Sony's policy on Personal Data Privacy relating to Customer's personal data should be in writing and addressed to:

Nothing herein shall limit the rights of Customers under the Personal Data (Privacy) Ordinance. All instructions and queries from Customer will be followed up and answered at the earliest.

13.Non-transferable.

The Service is non-transferable.
  

14.Other

Sony reserves the right to change the nature and content of the Service at any time.
